Two Programs Upcoming in May 2008

The American Arbitration Association and the International Mediation Institute (IMI) are offering a free program on “Certifying International Competency Standards for Mediators.” The program will focus on efforts to develop professional practice standards by which parties and their attorneys can select highly skilled mediators suitable for international disputes. As the program flyer states, “many stakeholders involved in international mediation are highly supportive of the efforts to create certification standards. But others - including several high-profile mediators - are not. Please join us … for what promises to be an animated and interactive discussion.” The speakers are Michael Leathes, Executive Director, IMI; Christopher Honeyman, Managing Partner of Convenor Conflict Management and Member, IMI Independent Standards Commission; Nancy Lesser, Adjunct Professor of Law, Georgetown Law and Founder, Pax ADR; and Wolf von Kumberg, European Legal Director of Northrop Grumman Corporation. The International Dispute Resolution Committee and Antitrust and Competition Committee of the DC Bar’s International Law Section, together with the Antitrust and Consumer Law Section, will present a luncheon program on “The Arbitration of Antitrust Claims in the U.S. and Europe.” The U.S. Supreme Court held in Mitsubishi Motors Corp. v. Soler Chrysler- Plymouth, Inc., 473 U.S. 614 (1985) (over a strong dissent) that claims under the U.S. antitrust laws must be adjudicated by arbitrators when those claims are within the scope of the parties’ arbitration agreement. Similarly, in Europe, many disputes involving issues under Articles 81 and 82 of the EC Treaty–the competition law rules–and the EC Merger Control Regulation have been subjected to resolution by arbitration. The arbitration of antitrust and competition law issues raises special concerns for arbitrating parties, their counsel, the arbitral community and the administration of justice. Our expert panel will address the pertinent state of the law in the U.S. and Europe in this area. The event will be moderated by Mark Joelson; the panelists are Daniel Margolis; Donald Baker, Baker & Miller PLLC; and Gordon Blanke, SJ Berwin LLP. The program will be held between 12:00 p.m. and 2:00 p.m. at Arnold and Porter LLP, 555 12th Street NW, 10th Floor (Metro Center), Washington DC. The cost is $5.00 for students; $15 for government and non-profit employees; $20 for Members of either the International Law Section or Antitrust and Consumer Law Section; and $30 for Non-Section Members.
